Article 1 - Definitions

Cooling-off period: The period during which the consumer can exercise their right of withdrawal.

Consumer: The person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.

Entrepreneur: The person who offers products and/or services to the consumer at a distance.

Distance contract: A contract whereby the entrepreneur's system for distance selling of products and/or services is used. This is used until the conclusion of the sales contract.

Communication technique at a distance: Technique used for the conclusion of the sales contract, without the consumer and the entrepreneur being simultaneously present in the same space.

Day: Calendar day.

Continuous transaction: A contract that aims at the regular delivery of goods, services, and/or digital content over a certain period.

Article 3 - Applicability

These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, before the distance contract is concluded, the entrepreneur will indicate how the general terms and conditions can be inspected by the consumer and that they will be sent free of charge at the consumer's request as soon as possible.

If the distance contract is concluded electronically, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can easily store them on a durable medium. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be inspected electronically and that they will be sent to the consumer free of charge electronically or in another way upon request. In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply mutatis mutandis, and the consumer can always rely on the applicable provision that is most favorable to him in the event of conflicting conditions.

Article 4 - The offer

The offer contains a complete and accurate description of the offered products, digital content, and/or services. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. If the entrepreneur uses images, these are a true representation of the offered products, services, and/or digital content. Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.

Each offer contains information in such a way that it is clear to the consumer what the rights and obligations are that are attached to the acceptance of the offer.

Article 5 - The agreement

The agreement is concluded, subject to the provisions of paragraph 4, at the moment of acceptance by the consumer of the offer and compliance with the conditions laid down therein.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically.

If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and he will ensure a secure web environment. If the consumer can pay electronically, the entrepreneur will take appropriate security measures for that purpose.

Within the legal framework, the entrepreneur can inquire whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, the entrepreneur has good grounds not to enter into the agreement, he is entitled to refuse a request or order or to attach special conditions to its execution.

Article 6 - The price

All prices quoted are in euros, including VAT.

All prices quoted include shipping and packaging materials.

During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes as a result of changes in VAT rates.

Article 7 - Performance and additional guarantee

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions and/or government regulations existing on the date of conclusion of the agreement. If agreed, the entrepreneur also guarantees that the product is suitable for normal use.

Any defects or incorrectly delivered products must be reported within 14 days to the contact point mentioned above.

However, returns of items are only accepted in unused condition and original packaging.

The warranty does not apply if:

The items or packaging have been processed or used.

The products or packaging have been handled carelessly and have been damaged.

Article 8 - Delivery and execution

The entrepreneur will take the greatest possible care when receiving orders for products and when assessing applications for the provision of services.

The address provided by the consumer to the entrepreneur applies as the place of delivery.

Subject to what is stated about this in article 4 of these general terms and conditions, the entrepreneur will execute accepted orders with due speed but no later than within 30 days, unless a longer delivery period has been agreed. If delivery is delayed or if an order cannot be executed or can only be executed partially, the consumer will be informed of this no later than 30 days after he has placed the order. In that case, the consumer has the right to terminate the contract free of charge and is entitled to any compensation.

After dissolution in accordance with the previous paragraph, the entrepreneur will immediately repay the amount paid by the consumer.

The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer or a pre-designated and notified representative to the entrepreneur, unless explicitly agreed otherwise.

Article 9 - Returns

Fully or partially processed goods, damaged goods, and packaged goods without packaging can never be returned.

Applications for returns will be accepted within 14 days after the consumer has received the product.

Article 10 - Payment

Unless otherwise agreed in the agreement or additional conditions, the amounts due by the consumer must be paid within 14 days after the cooling-off period has commenced, or in the absence of a cooling-off period, within 14 days after the conclusion of the agreement. In the case of an agreement to provide a service, this period starts on the day after the consumer has received confirmation of the agreement.

The consumer has the obligation to report inaccuracies in provided or stated payment details to the entrepreneur without delay.

Article 11 - Complaints procedure

The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

Complaints about the performance of the agreement must be submitted to the entrepreneur within a reasonable time after the consumer has discovered the defects, fully and clearly described.

Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within the period of 14 days with a message of receipt and an indication when the consumer can expect a more detailed answer.

The consumer must give the entrepreneur at least 4 weeks to resolve the complaint through mutual consultation. After this period, a dispute arises that is susceptible to the dispute settlement procedure.

Article 12 - Disputes

Only Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply.
